Participant Liability Waiver, Medical Declaration & Terms of Service

​Please read this document carefully before completing your booking. By ticking the confirmation box and enrolling yourself and/or your child in any program provided by Lidia Scotto di Vetta t/as Big Scrub Nature Play (“Big Scrub Nature Play”, “we”, “our”, or “us”), you acknowledge and agree to the terms below.

1. Inherent Risks & Acknowledgement

  • Nature of Activities: Our programs take place outdoors in natural bushland, parklands, and nature spaces. Activities involve inherent environmental risks, including but not limited to uneven and slippery ground, mud, water bodies, exposure to adverse weather, climbing trees, handling natural materials/tools, and encountering native wildlife or insects.

  • Assumption of Risk: You understand and accept that while Big Scrub Nature Play takes all reasonable safety precautions, participating in outdoor nature play carries an inherent risk of minor to serious injury (such as cuts, scratches, insect bites, sprains, fractures, or falls). You voluntarily assume all such risks on behalf of yourself and your registered child/ren.

 

2. Medical Declaration & Health Acknowledgment

 

To ensure participant safety and comply with our insurer’s conditions :

  • Medical Disclosure: You confirm that you have fully and accurately disclosed all relevant medical conditions, severe allergies (e.g., anaphylaxis), asthma, physical limitations, behavioural considerations, or medication requirements for your enrolled child during registration.

  • Physical Capability: You confirm that your child is in suitable physical health and condition to participate in outdoor, uneven terrain, and all-weather activities.

  • Updates: You agree to notify Big Scrub Nature Play immediately of any changes to your child’s medical status, emergency contact details, or authorised pickup contacts.

 

3. First Aid & Emergency Authorization

  • Qualified Care: Big Scrub Nature Play educators and mentors hold current First Aid, CPR, and Blue Card certifications .

  • Consent for Treatment: In the event of an injury, illness, or emergency involving your child, you authorise our staff/mentors to administer first aid or obtain urgent medical, ambulance, or hospital treatment.

  • Medical & Emergency Costs: In the event of an emergency requiring external medical or hospital attention, you authorise our facilitators to arrange emergency transportation (including an ambulance). Any medical, transport, or pharmaceutical costs incurred that are not covered by public healthcare remain the responsibility of the parent/guardian.

 

4. Supervision & Duty of Care: Program Specifics

 

Supervision responsibilities differ based on the format of the program enrolled :

  • Drop-Off Programs (e.g., Forest Kindy):

    • Big Scrub Nature Play educators and mentors provide direct supervision and assume duty of care during designated session times only.

    • Supervision commences once the child is formally signed in by a parent/guardian and ceases immediately upon sign-out to an authorised adult.

  • Accompanied / Family Programs (e.g., Playgroups & Family Nature Play):

    • Parents, guardians, or carers retain primary duty of care and supervisory responsibility for their child/ren at all times throughout the session.

    • Accompanying adults must actively monitor their child/ren’s safety and adhere to all facilitator instructions and boundary briefings.

 

5. Participant & Spectator Conduct

  • Safety Briefings: All participants and accompanying adults must listen to and comply with the facilitator’s safety instructions, boundary rules, and environmental risk briefings delivered at the start of each session.

  • Substances: Big Scrub Nature Play maintains an alcohol-free, smoke-free, and substance-free environment. No intoxicated person will be permitted to participate or attend.

 

6. Release & Limitation of Liability

  • Release: To the maximum extent permitted under the Queensland Civil Liability Act 2003 and the Competition and Consumer Act 2010 (Cth), you release and hold harmless Lidia Scotto di Vetta t/as Big Scrub Nature Play, its educators, mentors, contractors, volunteers, and property/land owners (including Noosa Shire Council and Sunshine Coast Regional Council) from any liability, claims, demands, or causes of action arising from personal injury, loss, or property damage sustained during the program, except where caused by gross negligence .

  • Personal Belongings: Big Scrub Nature Play accepts no responsibility for lost, damaged, or stolen personal items or clothing.

 

7. Photography & Media Consent

  • During sessions, photos or video clips may occasionally be captured to document activities or share updates on our social media/website.

  • If you do not consent to your child’s image being shared, please inform us in person and/or writing during your registration process.

 

8. Agreement & Declaration

 

By ticking the booking confirmation box and finalizing your enrollment, you certify that:

  1. You are the parent or legal guardian of the registered child/ren, with legal authority to enter into this agreement.

  2. You have read, understood, and agreed to all sections of this Liability Waiver, Medical Declaration, and Terms of Service.
